1. Agreement to Terms

Welcome to QtpiAI. These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service") operated by QtpiAI ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1.1 Eligibility

To use our Service, you must:

• Be at least 18 years old, OR
• Be at least 13 years old with verifiable parental or guardian consent
• Have the legal capacity to enter into a binding agreement

If you are under 18 years of age, your parent or legal guardian must agree to these Terms on your behalf and is responsible for your use of the Service.

1.2 Parental Responsibility

For users under 18, the parent or guardian creating the account:

• Agrees to these Terms on behalf of the minor
• Is responsible for the minor's compliance with these Terms
• Is the account holder for payment and billing purposes
• Has the authority to manage or delete the account

2. Account Registration

2.1 Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account credentials with others
• Notify us immediately of any unauthorized access to your account

2.2 Account Security

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

2.3 One Account Per Person

Each person may maintain only one account. Creating multiple accounts to circumvent restrictions or for any other purpose is prohibited.

3. Subscription and Payments

3.1 Subscription Plans

We offer the following subscription tiers (all prices in Canadian dollars):

Prices are subject to change. We will notify you of any price changes before they take effect on your next billing cycle.

3.2 Billing Cycles

Subscriptions are billed in advance on a recurring basis according to the billing cycle you select (monthly or annually). Your billing cycle begins on the date you subscribe and renews automatically on the same date each billing period.

3.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. The payment method on file will be charged the applicable subscription fee.

3.4 Payment Processing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fees and any applicable taxes. You agree to provide current, complete, and accurate billing information.

3.5 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will retain access to paid features until that date
• Your account will revert to the Free plan after the billing period ends
• No partial refunds will be issued for unused time in the current billing period

3.6 Refund Policy

To request a refund, contact us at support@qtpiai.com within the 7-day period.

3.7 Free Trials

If we offer a free trial, you may be required to provide payment information to start the trial. If you do not cancel before the trial ends, you will be automatically charged for the subscription plan selected. You may cancel during the trial period without charge.

3.8 Taxes

Subscription fees are exclusive of applicable taxes (including GST/HST in Canada). You are responsible for paying any taxes associated with your subscription.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

4.1 Prohibited Activities

You agree NOT to:

• Share Accounts: Share your login credentials or allow others to access your account
• Automated Access: Use bots, scrapers, or automated tools to access the Service
• Data Collection: Scrape, harvest, or collect data from the Service
• Reverse Engineering: Reverse engineer, decompile, or attempt to extract source code
• Circumvent Security: Bypass or attempt to bypass security measures
• Interfere with Service: Disrupt, overload, or impair the Service or its infrastructure
• Impersonation: Impersonate another person or misrepresent your identity
• Illegal Use: Use the Service for any illegal purpose

4.2 AI Tutor Usage

When using the AI tutor, you agree NOT to:

• Ask questions unrelated to math or educational content
• Attempt to manipulate the AI into producing inappropriate content
• Use the AI tutor during actual contest examinations (this constitutes cheating)
• Submit AI-generated work as your own in school assignments without disclosure
• Use the AI tutor to generate content for commercial purposes

4.3 Academic Integrity

QtpiAI is designed to help you learn and practice for math contests. Using our Service to cheat on actual contests or examinations is strictly prohibited. You are responsible for complying with your school's and contest organizer's academic integrity policies.

4.4 Reporting Violations

If you become aware of any misuse of the Service or violations of these Terms, please report it to us at support@qtpiai.com.

5. Intellectual Property

5.1 Our Content

The Service, including its design, features, text, graphics, logos, and software, is owned by QtpiAI and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

5.2 CEMC Contest Questions

Our Service includes practice questions from Waterloo CEMC math contests (Gauss, Pascal, Cayley, Fermat). These questions are the intellectual property of the Centre for Education in Mathematics and Computing (CEMC) at the University of Waterloo. We display these questions for educational purposes. You may not:

• Reproduce or redistribute contest questions outside of personal study
• Use contest questions for commercial purposes
• Claim ownership of CEMC contest content

5.3 User Content

You retain ownership of any content you submit to the Service (such as messages to the AI tutor). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content as necessary to provide and improve the Service.

5.4 AI-Generated Explanations

Explanations and responses generated by our AI tutor are provided for your personal educational use. These AI-generated explanations:

• Are provided "as-is" without warranty of accuracy
• May not be reproduced or distributed commercially
• Should be verified and not relied upon as authoritative sources

5.5 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.

6. AI Tutor Disclaimer

6.1 AI Limitations

Our AI tutor is powered by artificial intelligence technology. While we strive for accuracy:

• AI may make mistakes. Explanations may contain errors, incorrect calculations, or flawed reasoning
• AI responses are generated algorithmically and are not reviewed by human tutors in real-time
• The AI may not always understand the context of your question correctly
• Mathematical notation and complex formulas may sometimes be rendered incorrectly

6.2 Not a Substitute

The AI tutor is an educational tool and is not a substitute for:

• Professional human tutoring
• Classroom instruction from qualified teachers
• Official CEMC contest preparation resources
• Your own critical thinking and problem-solving

6.3 No Performance Guarantee

We do not guarantee that using our Service or AI tutor will result in:

• Improved contest scores or rankings
• Specific academic outcomes
• Qualification for awards, scholarships, or advanced programs

Your results depend on many factors including your effort, prior knowledge, and individual learning abilities.

6.4 Verification

We strongly encourage you to verify AI explanations against official solutions, textbooks, or consult with teachers when in doubt. Critical thinking and verification are essential parts of learning mathematics.

7. Service Availability

7.1 Best Effort Availability

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance (we will try to provide advance notice)
• Unscheduled maintenance or emergency repairs
• Technical issues, server failures, or network problems
• Third-party service outages (Supabase, Anthropic, Stripe, Vercel)
• Circumstances beyond our reasonable control

7.2 Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

7.3 No Uptime Guarantee

We do not provide any guarantee of uptime or service level agreement (SLA) for individual users. The Service is provided on an "as available" basis.

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Q(T)PI^AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Loss of goodwill or reputation
• Cost of substitute services
• Any damages resulting from errors in AI-generated content
• Any damages resulting from unauthorized access to your account
• Any damages relating to contest or academic performance

8.3 Maximum Liability

Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the greater of:

• The amount you paid to us in the 12 months preceding the claim, OR
• One hundred Canadian dollars ($100 CAD)

8.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. If these laws apply to you, some or all of the above exclusions or limitations may not apply, and you may have additional rights.

9. Indemnification

You agree to indemnify, defend, and hold harmless QtpiAI and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable law
• Content you submit to the Service

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

• Cancelling your subscription through your account settings
• Deleting your account through your account settings
• Contacting us at support@qtpiai.com to request account deletion

10.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Extended inactivity
• At our sole discretion for any other reason

10.3 Effect of Termination

Upon termination:

• Your right to access the Service will cease immediately
• Your subscription will not renew
• We may delete your account data in accordance with our Privacy Policy
• Provisions of these Terms that should survive termination will remain in effect (including limitations of liability, indemnification, and governing law)

10.4 No Refunds Upon Termination

If your account is terminated for violation of these Terms, you will not be entitled to any refund of subscription fees.

11. Governing Law and Disputes

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.

11.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Alberta, Canada, for the resolution of any disputes arising from these Terms or the Service.

11.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us at support@qtpiai.com and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.

11.4 Class Action Waiver

To the extent permitted by law, you agree that any disputes will be resolved on an individual basis. You waive your right to participate in a class action lawsuit or class-wide arbitration against QtpiAI.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of these Terms
• For material changes, we will notify you via email or a prominent notice on the Service
• Changes will become effective upon posting or on the date specified in the notice

Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and may cancel your subscription.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QtpiAI regarding the Service and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without your consent.

13.5 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.
